ASTERISK operates this online store and website, including all related information, content, features, tools, products and services (collectively, the “Services”).
Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer the Services to you.
These Terms & Conditions (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when using our Services.
Please read these Terms carefully before accessing or using our website.
By visiting, interacting with or using our Services, including placing an order, you agree to be bound by these Terms and the policies referenced herein.
If you do not agree to these Terms, you should not use or access our Services.
SECTION 1 – ACCESS & ONLINE STORE TERMS
By using the Services, you confirm that you are of legal age in your country or place of residence or otherwise legally capable of entering into the relevant transaction.
You may not use our products or Services for any unlawful or unauthorized purpose or violate any applicable laws or regulations.
You must not transmit viruses, malware, harmful code or other material intended to interfere with the operation or security of the website.
Where an account is available, you are responsible for maintaining the confidentiality and security of your account information.
Information you provide when using the Services, including your email address, billing information, payment information and shipping information, must be current, complete and accurate.
SECTION 2 – OUR PRODUCTS & HANDCRAFTED NATURE
ASTERISK jewelry is produced using a combination of traditional and contemporary jewelry-making processes.
Many pieces are individually made and finished by hand. As a result, slight variations in shape, surface, texture, oxidation, finishing, dimensions, stone appearance or other characteristics may occur between individual pieces.
These variations are part of the individual and handcrafted nature of our jewelry and are not necessarily considered defects.
We make reasonable efforts to display product photographs, colors, proportions, finishes and other characteristics accurately. However, the appearance of a product may vary depending on lighting, photography, screen settings and the device used to view the website.
Natural and individually sourced stones may vary in color, inclusions, pattern, shape and appearance.
Some ASTERISK jewelry may feature pointed, sharp, sculptural or unconventional forms. Customers should handle and wear these pieces with appropriate care.
Product descriptions, availability and specifications may be updated from time to time. We also reserve the right to discontinue products or limit quantities where reasonably necessary.
SECTION 3 – MADE-TO-ORDER PRODUCTS
Many ASTERISK pieces are individually produced after an order has been placed.
Applicable production times are stated on the relevant product page or in our Shipping & Returns Policy.
Production times are estimates and may occasionally vary due to material availability, casting, stone setting, external production processes or other circumstances.
Because production may begin specifically for an individual order, please contact us as soon as possible if you wish to request a change or cancellation.
Once production has begun, modifications or cancellations may no longer be possible, subject to applicable statutory consumer rights.
SECTION 4 – BESPOKE, PERSONALIZED & CUSTOM PRODUCTS
Bespoke, personalized, engraved, custom-sized and otherwise individually customized pieces are produced according to the customer's individual specifications.
Customers are responsible for providing accurate information regarding sizing, measurements, engraving, personalization, stone preferences and other requested specifications.
Where design approval is required, production may begin following the customer's approval of the relevant design or specifications.
Once a bespoke design or specification has been approved and production has begun, subsequent changes may result in additional costs or may no longer be possible.
Bespoke, personalized, engraved, custom-sized or otherwise individually customized products may be excluded from the statutory right of withdrawal where the applicable legal requirements for such an exclusion are met.
Separate quotations, design retainers, deposits, payment schedules or written agreements may apply to bespoke commissions. These will be communicated to the customer separately where applicable.
Where a separate written agreement specifically governs a bespoke commission, that agreement supplements these Terms.
SECTION 5 – SIZING
Customers are responsible for selecting or providing the correct size when ordering sized jewelry.
The fit of jewelry may vary depending on the width, shape, thickness and design of the piece.
For rings and other closely fitted jewelry, we recommend having your size professionally measured before ordering, particularly for bespoke or custom-sized pieces.
If an incorrect size has been selected or provided by the customer, resizing may not always be possible and may result in additional production, material, stone-setting, repair or shipping costs.
This does not affect statutory rights where the product supplied does not correspond to the size or specifications ordered.
SECTION 6 – ADJUSTABLE JEWELRY & PRODUCT CARE
Certain ASTERISK pieces may be designed to allow limited adjustment.
Adjustable jewelry should be handled carefully and should not be repeatedly bent, opened, closed or reshaped beyond what is reasonably necessary for fitting.
Repeated adjustment can cause metal fatigue, deformation or eventual breakage.
This is particularly important for designs featuring narrow or structurally delicate areas.
Customers should follow any product-specific care instructions included on the relevant product page or provided with the product.
Damage resulting from excessive bending, accidental damage, improper handling, unauthorized modification or failure to follow product-specific care instructions may not constitute a product defect.
SECTION 7 – ORDERS
When you place an order through our online store, you submit an offer to purchase the relevant products.
We reserve the right to refuse, limit or cancel an order where reasonably necessary and permitted by applicable law, including in cases of suspected fraud, product unavailability or obvious pricing or technical errors.
Payment must be successfully processed using one of the payment methods offered before an order can be fulfilled.
If we are unable to accept an order or need to make a material change to it, we will attempt to contact you using the contact information provided when the order was placed.
Please review your order carefully before submitting it.
If you discover an error or wish to request a change or cancellation after ordering, please contact us as soon as possible at contact@asteriskonline.eu.
Changes or cancellations may no longer be possible once production has begun or an order has been dispatched, subject to applicable statutory consumer rights.
SECTION 8 – PRICES & PAYMENT
Prices, promotions and discounts may change without prior notice.
The price applicable to an order will generally be the price displayed when the order is placed and confirmed, unless an obvious pricing or technical error has occurred.
Shipping charges are displayed separately where applicable.
Unless explicitly stated otherwise, international import duties, tariffs, taxes, customs fees and similar charges are not included in the product price or shipping fee.
For bespoke commissions, separate payment terms, design retainers, deposits or payment schedules may apply.
Customers agree to provide accurate and complete billing and payment information and to use payment methods they are authorized to use.
SECTION 9 – SHIPPING & DELIVERY
Shipping methods, shipping charges, estimated production and delivery times, international delivery information and procedures relating to returned, refused, unclaimed, lost or missing packages are described in our separate Shipping & Returns Policy.
Customers are responsible for providing complete and accurate shipping information when placing an order.
Delivery and production timeframes provided by ASTERISK are estimates unless expressly stated otherwise.
Delivery may be affected by customs processing, carrier delays, public holidays, weather and other circumstances outside our reasonable control.
Nothing in these Terms transfers shipping risk to a consumer where such a transfer would be contrary to applicable law.
SECTION 10 – CUSTOMS, DUTIES, TARIFFS & TAXES
Orders shipped outside the European Union may be subject to import duties, tariffs, taxes, customs fees or other charges imposed by the destination country.
Unless explicitly stated otherwise, these charges are not included in the product price or shipping fee and are the responsibility of the recipient.
ASTERISK does not determine or control these charges.
Customers placing international orders are responsible for checking applicable import requirements and potential charges in their destination country before ordering.

SECTION 11 – RETURNS, REFUNDS, CANCELLATIONS & REPAIRS
Returns, refunds, cancellations, exchanges and repairs are governed by our separate Shipping & Returns Policy together with any mandatory statutory consumer rights that apply.
Our commercial policy is that all sales are final, subject to mandatory statutory consumer rights.
Bespoke, personalized, engraved, custom-sized or otherwise individually customized products may be excluded from return or withdrawal where permitted by applicable law.
Nothing in these Terms or our Shipping & Returns Policy limits statutory rights relating to defective, damaged or incorrectly supplied products.
SECTION 12 – INTELLECTUAL PROPERTY
Unless otherwise stated, all content displayed through the Services, including jewelry designs, photographs, images, graphics, text, logos, branding, videos and other creative material, is owned by or licensed to ASTERISK and is protected by applicable intellectual property laws.
Content may not be reproduced, copied, distributed, modified, commercially exploited or otherwise used without prior permission where such permission is legally required.
Purchasing an ASTERISK product does not transfer any intellectual property rights in the underlying jewelry design, artwork, photography, branding or other creative material.
The ASTERISK name, logo and associated designs may not be used in a manner that falsely suggests affiliation with, sponsorship by or endorsement from ASTERISK.
SECTION 13 – OPTIONAL TOOLS
We may provide access to tools offered by third parties as part of the Services.
We do not necessarily monitor or control these third-party tools.
Your use of optional third-party tools may be subject to the relevant provider's terms, conditions and privacy policies.
We may introduce new tools, features or resources through the Services from time to time. Such features will also form part of the Services and may be subject to these Terms.
SECTION 14 – THIRD-PARTY LINKS
The Services may contain links, integrations or content provided by third parties.
ASTERISK is not responsible for examining or evaluating the accuracy, content, availability or practices of independent third-party websites.

SECTION 15 – RELATIONSHIP WITH SHOPIFY
Our online store is powered by Shopify, which enables us to provide the Services to you.
However, products purchased from the ASTERISK online store are sold by ASTERISK and not by Shopify.
Shopify is not the seller of ASTERISK products and is not responsible for fulfilling orders, manufacturing products or providing ASTERISK customer service.
Your use of Shopify-related functionality may additionally involve Shopify's own terms and privacy practices.
SECTION 16 – PRIVACY
Personal information collected through the Services is processed in accordance with our Privacy Policy.
Because our online store is hosted by Shopify, certain personal information may also be processed by Shopify and other service providers where necessary to operate the online store and provide the Services.

SECTION 17 – FEEDBACK & SUBMISSIONS
If you voluntarily submit feedback, suggestions, reviews, ideas or other content to ASTERISK, you confirm that you have the necessary rights to provide that content.
You agree not to submit content that infringes third-party rights or contains unlawful, abusive, defamatory, obscene, fraudulent or malicious material.
You may not impersonate another person or intentionally misrepresent the origin of a submission.
Where you provide content for publication, such as a product review, you grant us the rights reasonably necessary to display and use that content in connection with our Services, subject to applicable law.

To the maximum extent permitted by applicable law, ASTERISK is not responsible for losses resulting solely from improper use, unauthorized modification, failure to follow care instructions or circumstances outside our reasonable control.
Nothing in these Terms limits statutory consumer rights, warranty rights, product liability or any other liability that cannot legally be excluded or limited.
SECTION 21 – SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision shall be interpreted or limited to the extent necessary under applicable law.
The validity and enforceability of the remaining provisions will not be affected.

These Terms remain effective while you use the Services.
We may suspend or terminate access to the Services where a user materially violates these Terms or applicable law.
Rights and obligations arising before termination remain unaffected where applicable.
SECTION 23 – ENTIRE AGREEMENT
These Terms, together with the policies and legal notices referenced on our website, govern use of the ASTERISK online store.
Our Shipping & Returns Policy and Privacy Policy should be read together with these Terms where applicable.
Separate written agreements relating to bespoke commissions, collaborations, wholesale arrangements or other Services may supplement these Terms.
Where a separate agreement specifically governs a particular transaction or Service, that agreement will apply to that transaction alongside these Terms.
SECTION 24 – GOVERNING LAW
These Terms and contractual relationships with ASTERISK are governed by the laws of the Federal Republic of Germany.
For consumers, this choice of law does not deprive them of mandatory consumer protection provisions applicable under the laws of their country of habitual residence where such protections cannot legally be excluded.
SECTION 25 – CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our products, Services, business practices or applicable legal requirements.

Material changes will apply in accordance with applicable law.
